Terms of Service
Last updated October 7, 2026
These terms are an agreement between you and The Biggest Nerd LLC (“we”, “us”), a Georgia limited liability company, for your use of The Biggest Nerd (the “service”). By creating an account or using the service you agree to them. If you are agreeing on behalf of a business, you confirm you can bind it, and “you” means that business.
1. The service
The Biggest Nerd is an AI chat assistant you add to your own website, managed from a dashboard. Which features you can use depends on your plan, as shown on the pricing page. Features marked “In development” or “soon” are not yet available and are not part of what you are paying for until they are released.
2. Your account
- You must be at least 18 and give us accurate information.
- Keep your password private. You are responsible for what happens under your account.
- Tell us promptly at [email protected] if you think your account has been accessed without permission.
3. Plans, billing and cancellation
- The free plan includes 100 replies a month and needs no card. Paid plans are billed monthly in advance, in US dollars, through Square, and renew each month until cancelled.
- There is no contract, no minimum term and no setup fee.
- You can cancel any time from your dashboard. Cancellation stops the next renewal; you keep the plan for the rest of the month you have paid for. We do not refund part-months.
- Each plan includes the number of replies shown on the pricing page. Pages and notes you teach the assistant are not metered.
- We may change prices. We will email you at least 30 days before a change affects your subscription, and you can cancel before it takes effect.
- If a payment fails and is not resolved, we may move the account to the free plan.
4. Your content
You own what you give the service — your pages, feeds, notes and settings — and the conversations and leads the assistant collects on your site. You give us permission to store, copy and process that material only as needed to run the service for you. That permission ends when you delete it or close your account, apart from backups that expire in the normal course.
You are responsible for:
- having the right to use the material you give the assistant;
- telling visitors to your site, in your own privacy notice, that a chat assistant operated by a service provider handles their questions, and getting any consent the law in your area requires;
- not giving the assistant material it should not repeat: payment card numbers, passwords, health records or other sensitive personal information.
How we handle personal information is described in our privacy policy.
5. AI answers
The assistant is designed to answer only from the material you give it, and to say so when that material does not cover a question rather than guess. It is still an AI system and can be wrong: it can misread a page, or answer from material that is out of date. You are responsible for keeping your pages and notes accurate, and for reviewing the conversations in your dashboard. Answers given on your site are not legal, medical, financial or other professional advice, and we are not a party to any transaction between you and your customers. The same applies to product suggestions the assistant makes: they come only from the feed you provide, so keep it current.
6. Acceptable use
You agree not to:
- use the service for anything illegal, deceptive, harassing or harmful;
- run the assistant on a website you do not own or control;
- use it to impersonate another business or person;
- attempt to break, overload, probe or get around the service’s security or usage limits, or use automated means to extract data from it;
- copy, resell or reverse-engineer the service, or use it to build a competing one.
We may suspend an account that breaks these rules, and will tell you why.
7. Availability and changes
We work to keep the service running and answering, but we do not promise it will be uninterrupted or error-free. We may improve, change or retire features; if we remove something material to a paid plan, we will give you notice and you can cancel.
8. Our property
The service itself — the software, the assistant, the dashboard, the website and the The Biggest Nerd name and logo — belongs to us. These terms give you the right to use it while your account is in good standing, and nothing more.
9. Third-party services
The service relies on others, including Square for payments and AI model providers. Their own terms apply to their part, and we are not responsible for services we do not control.
10. Ending the agreement
You can stop using the service and close your account at any time. We can end these terms or suspend the service if you materially breach them, or with 30 days’ notice for any other reason, in which case we will refund any unused prepaid period. Sections 4 to 6 and 8 to 14 survive the end of the agreement.
11. Disclaimer
Except as these terms expressly say, the service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the fullest extent the law allows, neither of us is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose, or $100 if that is greater. Some places do not allow these limits, so they may not all apply to you.
13. Indemnity
You will defend and indemnify us against third-party claims arising from the material you give the service, your website, or your breach of these terms.
14. Law and disputes
These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Whitfield County, Georgia, and both of us agree to their jurisdiction. Before going to court, please contact us — most problems are fixed faster by email.
15. Changes to these terms
We may update these terms. We will change the date at the top, and email customers at least 30 days before a change that reduces their rights takes effect. Continuing to use the service after that means you accept the new terms.
